A. Ownership:
The Instrument and all included accessories remain the sole property of the Owner, at all times. This Agreement grants the Renter the right to use the Instrument only.
B. Care of Instrument:
The Renter agrees to exercise due care to maintain the Instrument in the same condition as it was received. This includes:
- Protecting it from exposure to extreme temperatures, humidity, or direct sunlight.
- Preventing any unauthorized repairs, alterations, or adjustments.
- Using the Instrument only for its intended musical purpose.
C. Normal Wear and Tear:
Normal wear and tear is defined as minor surface scratches or scuffs that do not affect the playability or structural integrity of the Instrument. Damage such as cracks, deep scratches, broken parts, or water damage is not considered normal wear and tear.
D. Damage, Loss, or Theft:
The Renter assumes full responsibility for any damage, loss, or theft of the Instrument.
- The Renter must notify the Alzavi Rental office immediately at 510-329-7229 in the event of any significant damage, loss, or theft.
- The Renter will be held liable for the cost of repairs for any damage exceeding normal wear and tear.
- In the case of loss, theft, or damage beyond repair, the Renter will be responsible for the full "Estimated Replacement Value" stated in Section 2.
E. Late Fees:
A late fee of $15.00 will be assessed if the monthly payment is not received within five (5) days of the due date.
F. Termination:
This Agreement may be terminated by the Renter at any time by providing 15 days' written notice to alzavirentals@gmail.com and returning the Instrument. The final month's rent is not prorated. The Owner reserves the right to terminate this agreement if the Renter fails to comply with its terms.
